These Terms of Service (the Terms) govern your access to and use of the MadeDay website, application, and services (collectively, the Services), provided by Burak Emre Taşer (sole proprietor, trading as MadeDay), established in Türkiye, with a registered address at Orta Mah. 4408 Sk. Botanik Park Evleri C/4, Serdivan, Türkiye (MadeDay, we, us, or our). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The service
MadeDay is a productized design and front-end subscription. We deliver design and working front-end code from a queue you control, one active request at a time, on a flat recurring fee. The scope of work, turnaround, and inclusions are described on our website and may be updated from time to time.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for your account credentials and for all activity under your account. Notify us at hello@madeday.co of any unauthorized use.
3. Subscriptions and billing
- The subscription fee is US$5,990 per month at the standard rate, or US$2,500 per month for founding members (the first 3 members, locked for the life of the subscription). Your subscription renews automatically each period until paused or canceled. By subscribing, you authorize recurring charges. We do not store full card details.
- Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
- Your purchase is also subject to the Paddle Buyer Terms (paddle.com/legal/checkout-buyer-terms). Paddle collects any applicable sales taxes for your country of residence as the merchant of record.
4. Requests, deliverables, and turnaround
You may submit unlimited requests to your queue and prioritize them. We work on one active request at a time and aim to deliver each within approximately 48 hours per task. Turnaround is a target, not a guarantee, and depends on scope, your responsiveness, and the materials you provide.
5. Revisions and acceptance
Revisions are unlimited within the original scope of a request. A request is considered accepted when you approve it or when it is marked shipped and you raise no revision within 7 days.
6. Intellectual property and ownership
Subject to full payment of the fees due, we assign to you all right, title, and interest in the final deliverables we create specifically for you, excluding any third-party materials, open-source components, and our pre-existing or general-purpose tools, libraries, and know-how, which we retain and license to you on a non-exclusive basis to the extent embedded in the deliverables. You are responsible for ensuring you hold the rights to any materials you provide to us.
7. Your responsibilities and acceptable use
You agree not to use the Services to:
- infringe any intellectual property, privacy, or other rights;
- submit unlawful, harmful, or infringing content or requests;
- resell or sublicense the Services except as permitted in writing; or
- interfere with or attempt to gain unauthorized access to the Services.
8. Confidentiality
Each party will protect the non-public information disclosed to it by the other party in connection with the Services and use that information only to perform under these Terms.
9. Pause, cancellation, and refunds
You may pause or cancel your subscription at any time from your account. Pausing preserves your remaining days for later use. Refunds are governed by our Refund Policy, which forms part of these Terms.
10. Disclaimers
The Services are provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, MadeDay will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data. Our total liability for any claim arising out of or relating to the Services will not exceed the amounts you paid to us in the 3 months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless MadeDay from claims arising out of materials you provide or your misuse of the Services.
13. Termination
We may suspend or terminate your access if you breach these Terms. On termination, your right to use the Services ends; sections that by their nature should survive will survive.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a new effective date and, where required, notify you. Continued use after changes take effect constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of Türkiye, without regard to conflict-of-laws rules. The courts and execution offices of Sakarya, Türkiye will have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.
